Terms of Use

Introduction

Welcome to ChildSafe AI. This document sets out the Terms of Use for the access or usage of ChildSafe AI (“Platform”), in compliance with the provisions of Rule 3 of the Information Technology (Intermediaries Guidelines) Rules, 2011, which require publishing the rules and regulations, privacy policy, and Terms of Use.

The Platform is owned by Dynamic Signature India Pvt Ltd, a company incorporated under the Companies Act, 2013, having its registered office at Meloot Shalom, Mundancavu P.O., Chengannur, Alappuzha – 689124, Kerala, India.

Definitions

For the purpose of this Terms of Use, the following definitions apply:

  • We / Us — ChildSafe AI under the company Dynamic Signature India Pvt Ltd.
  • User / Users — Any person or persons who access or use the ChildSafe AI website, web application, chat services, School Solutions, or any other products, features, apps, technologies, software, or services offered by us.
  • Platform — The ChildSafe AI website and all of its affiliated products, services, features, and software.

Acceptance of Terms

When a User avails any of the services provided by us through the Platform, they will be subject to all rules, conditions, policies, and guidelines applicable to that service, which shall be deemed incorporated into this Terms of Use.

We reserve the right to change, modify, add, or remove portions of this Terms of Use at our discretion and without prior notice to Users. Continued use of or access to the Platform will mean acceptance of the revised Terms. Users shall regularly review the Terms of Use for any changes. Acceptance of this Terms of Use also means acceptance of our Privacy Policy, which is incorporated by reference.

Services Offered

ChildSafe AI provides a platform for age-appropriate, location-aware AI-assisted learning and conversation. Our services include:

  • Chat services — AI-powered chat with different companion modes (e.g., companion, subject teacher, communication coach, expert) designed for use by children under parental or guardian supervision.
  • School Solutions — Tools and features for schools, teachers, and institutions as described on the Platform.
  • Related features — Profile management, session history, optional upload of notes and question papers for AI-assisted study Q&A, and other features offered through the Platform.

Our services use one or more large language models (LLMs) and may use real-time web search when extra context is needed. We do not warrant that AI-generated output is complete, accurate, or suitable for any particular purpose.

Eligibility and Minors

Use of ChildSafe AI is available only to persons who can form a legally binding contract under the Indian Contract Act, 1872. If you are a minor, i.e., under the age of 18 years, you may use ChildSafe AI only with the involvement of a parent or lawful guardian.

ChildSafe AI is designed for use by children under parental or guardian supervision. Our services require a parent or guardian to create an account and verify their identity (for example, via phone). We process personal data of children only after obtaining verifiable consent of the parent or lawful guardian, in accordance with the Digital Personal Data Protection Act, 2023. Rules and Conduct

The User agrees to follow and be bound by the following rules of conduct while using the Platform:

  • The User shall not publish, transmit, or prompt any content that is illegal, offensive, deceptive, misleading, abusive, indecent, harassing, pornographic, harmful to minors, or otherwise objectionable; that impersonates another person; that threatens the unity, integrity, security, or sovereignty of India; or that consists of or contains software viruses or other harmful components (“Objectionable Content”). Users engaging in such conduct shall be barred from the Platform, and such content may be removed.
  • The User shall not use the Platform for any unlawful or fraudulent purpose, or in a manner that abuses any policy or rules of the Platform or interrupts or hinders the use of the Platform by other Users.
  • The User shall not impersonate any person or legal entity, or attempt to mislead the Platform or engage in transactions with mala fide intentions.
  • The User shall not use any automatic device, program, algorithm, or manual process to access, acquire, copy, or monitor any portion of the Platform, or to obtain materials or information through any means not purposely made available through the Platform. We reserve the right to bar any such activity.
  • The User shall not attempt to gain unauthorised access to any aspect of the Platform, or any systems or networks connected to the Platform, through hacking or any other illegitimate means.
  • The User shall ensure full compliance with the Information Technology Act, 2000 and rules thereunder, and all applicable domestic and international laws, rules, and regulations.

If we determine that a User has clearly, seriously, or repeatedly breached our Terms or policies, we may suspend or permanently disable access to their account. We may also suspend or disable accounts where we are required to do so for legal reasons.

Content

User content. You are responsible for the content you create, share, or submit through our services (including chat prompts and messages). You represent that you have the right to provide such content. We are not responsible for any claims, damages, or losses resulting from user-generated content.

AI output. Responses generated by the AI are produced by predictive models and may be incomplete, inaccurate, or inappropriate. You should not rely on AI output as a sole source of truth or as a substitute for professional advice. Parents and guardians are responsible for supervising their children's use of our services and for any reliance on the information provided. See our Privacy Policy — A Note About AI Accuracy.

Platform content. Text, graphics, user interfaces, trademarks, logos, and artwork made available by us on the Platform are our property or our licensors' property. You may use materials purposely made available for downloading only for personal, non-commercial use, and you shall not remove proprietary notices, modify such materials, or use them in any way that infringes our or third parties' rights. You may not use our trademarks, logos, or similar marks without our prior written permission.

Privacy and Data

Our collection, use, and sharing of personal data are described in our Privacy Policy. By using the Platform, you consent to such practices. We follow the guidelines and obligations under the Digital Personal Data Protection Act, 2023 (DPDP Act). You have rights in relation to your personal data, including access, correction, erasure, and withdrawal of consent. See Your Rights and Complaints and contact us to exercise these rights.

Fees, payment, and subscriptions

Certain features of the Platform may be offered free of charge (including a limited free trial where we make it available). Paid plans, top-ups, and other fee-based services are described on our Pricing page and at checkout. Prices are in Indian Rupees unless stated otherwise and may be shown exclusive or inclusive of applicable taxes (such as GST) as indicated at the time of purchase. You agree to pay all fees and taxes associated with your selected plan or purchase.

Interactions. Where we refer to usage limits, an “interaction” means each unit we count against your plan when you use chat or related features. Typically, one interaction corresponds to one user message and the assistant's main reply to that message (or as further described in our Privacy Policy). Unused interactions in a billing period may expire at the end of that period unless we expressly state otherwise.

Notes power modes — Eco, Power, and Super power. In notes and uploaded-document Q&A, you choose how much capability to use per question. That choice sets how many interaction units we deduct for that question: Eco 1 unit, Power 2 units, and Super power 3 units, including the main reply and suggestion chips returned in the same response (see Suggestion chips above for how main Chat differs). These modes are not separate paid products or rupee prices; they only change how many units we take from your plan or trial balance. Suggestion chips (“Try asking next”). When this optional feature is enabled for an assist style in main Chat (for example Subject teacher, Communication coach, or Companion), the Platform also generates short follow-up suggestions after a reply. That suggestion step is billed as an additional interaction for the same turn—so a single send with suggestions on may count as two interactions (one for the main answer and one for generating the tailored suggestions), depending on your settings. You may disable suggestion chips per child profile and per assist style at any time in Settings → Preferences, which avoids the extra interaction charge for those modes (you will not receive clickable suggestion chips for modes you turn off). In notes and uploaded-document Q&A, follow-up suggestion chips are not billed as a separate interaction; usage for that send follows the Eco / Power / Super power rules below only.

Recurring billing. If you subscribe to a recurring plan (for example, monthly or annual), you authorise us and our payment partners to charge your chosen payment method on the billing cycle you select until you cancel in accordance with the cancellation process we provide. You are responsible for keeping payment details current. We may suspend or restrict access to paid features if a payment fails or is disputed until the matter is resolved.

Changes to fees. We may change our prices or introduce new plans. Where required by law, we will give you reasonable notice. Continued use of paid services after a price change may constitute acceptance; if you do not agree, you may cancel as permitted below.

Cancellation by you. You may cancel a subscription or stop using paid services as described in the Platform or checkout flow. Cancellation stops future charges from the next billing cycle where applicable; it does not entitle you to a refund for the current period except as stated below.

No refunds. Except where required by applicable law, all fees for subscriptions, top-ups, trials that convert to paid plans, or other paid services are non-refundable. If you cancel your subscription or your account, or if we suspend or terminate your access in accordance with these Terms, you will not receive a refund for any fees already paid for the current billing period or for any unused portion of your subscription, interactions, or top-ups. This applies whether cancellation is initiated by you or by us (except where mandatory law requires a different treatment).

Billing disputes and questions. For billing errors, invoice questions, payment failures, or disputes relating to charges, you must contact us at contact@childsafe.in and contact@safebrowse.ai before initiating a chargeback with your bank or payment provider, so we can try to resolve the issue. We may require reasonable information to verify your account and the transaction.

Payment processors. Payments may be processed by third-party providers (such as payment gateways). Their terms and privacy policies apply to payment processing. We are not responsible for fees or failures caused solely by your bank, card issuer, or payment network.

Disclaimer — Liability and Warranties

We do not warrant that the Platform will be available constantly or at all, or that information on the Platform is complete, accurate, or not misleading.

AI-generated output may be incomplete, outdated, or wrong. We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose. You use the Platform and rely on its output at your own risk.

In no event shall we be liable for any indirect, punitive, incidental, special, consequential, or other damages resulting from (i) the use or inability to use the services; (ii) unauthorised access to or alteration of your data; (iii) any matter relating to the services; or (iv) any breach of condition, representation, or warranty by us or any third party. To the maximum extent permissible under law, our liability shall be limited as we may determine.

We shall not be held responsible for non-availability of the Platform during periodic maintenance or any unplanned suspension of access. We may unilaterally terminate or suspend a User's account for reasons set out in these Terms. We will have no liability to you or any third party for doing so.

Document uploads and notes

The Platform may allow you to upload photos of notes, question papers, and other educational documents (“Uploaded Documents”) for secure storage, text extraction, and AI-assisted question-and-answer based on those materials.

  • Interaction cost — Each image uploaded may consume 3 interaction units from your subscription or trial balance at the time of upload, covering storage, text extraction, and indexing. Each question you ask about your Uploaded Documents consumes interaction units according to your selected notes power mode: Eco 1 unit, Power 2 units, or Super power 3 units for that send, including the assistant's main reply and any suggestion chips returned with it in the same response.
  • Annual upload limit — We may enforce a maximum of 500 images per child profile per rolling twelve-month period for Uploaded Documents. If you reach this limit, you may need to wait until older uploads fall outside that window or delete existing batches before uploading more.
  • Privacy and access — Uploaded Documents are accessible only to the specific child profile under your account that uploaded them. They are not shared with other profiles, accounts, or users. We store images and derived text solely to provide this feature to you.
  • Retention — Uploaded Documents, including stored images and extracted text, are retained for one year from the date each upload batch is created, after which they may be permanently deleted. You may delete batches earlier at any time where the Platform provides that control. This retention period also applies when your account remains active; deletion on account termination may occur sooner or in line with our general data practices described in the Privacy Policy.
  • Content responsibility — You are responsible for ensuring you have the right to upload and use the content in your documents. We do not claim ownership of your Uploaded Documents.

Termination

We may terminate or suspend your access to the Platform or your account if we determine that you have breached these Terms or our policies, that we must do so to comply with the law, or that your use could cause risk or harm to us, our users, or others. You may stop using the Platform at any time. Upon termination, your right to use the Platform ceases immediately.

Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without reference to conflict of laws principles. Disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts, tribunals, and fora at Alappuzha, Kerala.
